1. The agreement
These Terms of Use ("Terms") are an agreement between you and Nihilio Yapay Görme Simülasyon Yazılım San. ve Tic. Ltd. Şti. ("Nihilio Vision", "we", "us"), Kocaeli Üniversitesi Teknopark, Başiskele, Kocaeli, Türkiye, for use of the Mini Art app ("Mini Art").
You must be an adult with legal authority to accept these Terms, such as a parent, legal guardian or teacher using Mini Art with children. By installing or using Mini Art, you accept these Terms and our Privacy Policy. If you don't agree, please don't use Mini Art.
2. Parental set-up and supervision
Mini Art is designed for children aged 3 and up. A parent or legal guardian should install Mini Art and supervise how and how long a child uses it. Buying content and sharing paintings are protected by a parental question. Please keep its answer away from children.
3. Your licence to use Mini Art
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Mini Art on devices that you own or control, for your family's or your classroom's non-commercial use. On Apple devices, this use is also subject to the Usage Rules in the Apple Media Services Terms and Conditions; on Android devices, to the Google Play Terms of Service.
4. Purchases
- Mini Art is free to download. Some paintings, patterns and wallpapers can be unlocked with optional one-time in-app purchases. Mini Art has no subscriptions. Prices and content are shown before you buy.
- Payments are processed by the app store (Apple's App Store or Google Play) and charged to your store account. The store's terms govern billing, refunds and Family Sharing. We never see your payment details.
- Refund requests are handled by the store: for Apple, at reportaproblem.apple.com.
- If you reinstall Mini Art or use another device with the same store account, use Restore to unlock your content again.
- Purchases are restricted by a parental question. We do not use manipulative purchase prompts aimed at children.
5. About the artworks and stories
Mini Art's pictures are our own child-friendly drawings inspired by famous artworks; they are not reproductions of the originals. The stories are written for children and simplify history. They are meant to spark curiosity, not to serve as a reference work.
6. Updates and availability
We may release updates that fix issues or change, add or remove features and content. Some updates may be required to keep using Mini Art. We may also stop offering Mini Art. If we do, we will try to give reasonable notice. Paintings saved on your device remain yours.
7. Intellectual property
Mini Art, including its software, drawings, characters, stories, narration, music, sounds and the Mini Art and Nihilio Vision names and logos, is owned by Nihilio Vision or its licensors and protected by intellectual property laws. These Terms don't transfer any ownership to you. The paintings your child colours in Mini Art are yours to keep and share for personal, non-commercial use.
If you send us feedback or suggestions, we may use them without obligation to you.
8. Acceptable use
You agree not to:
- copy, modify, distribute, sell or rent Mini Art or its content, except as the law expressly allows;
- reverse-engineer, decompile or attempt to extract source code or content, except where the law permits this despite this restriction;
- bypass parental questions, purchase controls or security features; or
- use Mini Art in a way that is unlawful or harmful to a child.
9. Privacy
Our Privacy Policy explains how Mini Art handles information. In short, Mini Art collects no personal information from children, has no accounts, ads or analytics, and keeps paintings and settings only on the device.
10. Disclaimers
To the extent permitted by law, Mini Art is provided "as is" and "as available". We don't promise that Mini Art will be uninterrupted or error-free. Nothing in these Terms excludes warranties or rights that cannot be excluded under the consumer protection law that applies to you, including Türkiye's Law No. 6502 on Consumer Protection and the mandatory laws of your country of residence.
11. Limitation of liability
To the extent permitted by law, Nihilio Vision is not liable for indirect, incidental, special or consequential damages. Our total liability for any claim relating to Mini Art is limited to the amount you paid for Mini Art in the 12 months before the claim, or USD 50 if you paid nothing.
These limits don't apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud or gross negligence.
12. Apple-specific terms
If you downloaded Mini Art from Apple's App Store:
- These Terms are between you and Nihilio Vision, not Apple. Nihilio Vision, not Apple, is solely responsible for Mini Art and its content.
- Apple has no obligation to provide maintenance or support for Mini Art.
- If Mini Art fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for Mini Art.
- Nihilio Vision, not Apple, is responsible for addressing any claims relating to Mini Art, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Termination
You may stop using Mini Art at any time by deleting it. We may end your licence if you seriously or repeatedly breach these Terms. Sections 7, 10, 11, 12, 14 and 15 continue to apply after termination.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye. Disputes will be resolved by the courts and enforcement offices of Kocaeli, Türkiye. Consumers may also apply to the consumer arbitration committees and consumer courts that have jurisdiction. If you are a consumer living in the EU/EEA, the UK or another country, you keep the protection of the mandatory laws of your country and may bring proceedings in your local courts.
15. General
We may update these Terms. When we do, we will change the date above and, for significant changes, tell you in the app beforehand. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us about Mini Art. If these Terms are translated, the English version prevails to the extent permitted by law.
