ArtiKO Terms of Service

1. The agreement

These Terms of Service ("Terms") are an agreement between you and Nihilio Yapay Görme Simülasyon Yazılım San. ve Tic. Ltd. Şti. ("Nihilio Vision", "we", "us"), Kocaeli Üniversitesi Teknopark, Başiskele, Kocaeli, Türkiye, for use of the ArtiKO app and related services ("ArtiKO").

You must be an adult with legal authority to accept these Terms, such as a parent or legal guardian, or a clinician using ArtiKO with a child whose parent or guardian has agreed. By installing or using ArtiKO, you accept these Terms and our Privacy Policy. If you don't agree, please don't use ArtiKO.

2. Clinical disclaimer

• Practice, not therapy. ArtiKO provides structured, game-based practice of speech movements and sounds. It supports, and does not replace, assessment and therapy by a qualified speech-language pathologist.
• No diagnosis. ArtiKO does not diagnose, screen for, treat, cure or prevent any disease or condition, including speech sound disorders or childhood apraxia of speech. Nothing in the app, its reports or this website is medical advice.
• Reports are practice records. Metrics and PDF reports describe what a child did inside ArtiKO's activities. They are not standardised clinical assessments, are not compared with population norms, and should be interpreted by a qualified professional.
• Technology has limits. Face tracking and sound analysis can be affected by lighting, device position, background noise and a child's individual differences. ArtiKO may sometimes accept or not accept an attempt incorrectly.
• Seek professional help. If you have concerns about your child's speech, hearing, swallowing, breathing or development, consult a qualified professional. Don't delay or disregard professional advice because of anything in ArtiKO. ArtiKO is not for emergencies.

3. Parental set-up and supervision

ArtiKO is designed for children aged 3–7. A parent or legal guardian must install and set up ArtiKO, create the child's profile, decide on optional settings such as research sharing, and supervise the child's use. Areas intended for adults (including settings, reports, purchases and external links) are protected by a parental gate. Please keep that gate from being used by children.

If a clinician uses ArtiKO with a child, the clinician is responsible for obtaining any consent required from the child's parent or guardian and for following their professional obligations.

4. Safe and comfortable use

• Use ArtiKO in a safe, well-lit place with the device on a stable surface. Stop if your child seems tired, frustrated or uncomfortable.
• ArtiKO's daily journey is limited to about ten minutes of active play. Please respect your child's limits and any practice schedule your SLP recommends.
• Encourage a comfortable voice. Stop if your child strains their voice or reports discomfort.

5. Your licence to use ArtiKO

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use ArtiKO on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, for your family's non-commercial use, or, for clinicians, for use with your clients.

6. Purchases and subscriptions

• ArtiKO may offer optional in-app purchases or subscriptions through Apple's App Store (StoreKit). Prices, content and billing periods are shown before you buy.
• Payments are processed by Apple and charged to your Apple Account. Apple's terms govern billing, renewals, refunds and Family Sharing.
• Auto-renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel them in your Apple Account settings. Cancelling stops future renewals; it doesn't refund the current period unless Apple decides otherwise or the law requires it.
• Refund requests are handled by Apple at reportaproblem.apple.com.
• Purchases are restricted by a parental gate. We do not use manipulative purchase prompts aimed at children.

7. Updates and availability

We may release updates that fix issues, improve accuracy, or change or remove features. Some updates may be required to keep using ArtiKO. We may also stop offering ArtiKO. If we do, we will try to give reasonable notice. Your practice records stay on your device and in your private iCloud and remain yours. ArtiKO requires iOS 17 or later; full face-and-voice feedback requires a device with a TrueDepth camera.

8. Intellectual property

ArtiKO, including its software, algorithms, game designs, characters, artwork, sounds, curriculum and the ArtiKO and Nihilio Vision names and logos, is owned by Nihilio Vision or its licensors and protected by intellectual property laws. These Terms don't transfer any ownership to you. Your family's practice records belong to you.

If you send us feedback or suggestions, we may use them without obligation to you.

9. Acceptable use

You agree not to:

• copy, modify, distribute, sell or rent ArtiKO, except as the law expressly allows;
• reverse-engineer, decompile or attempt to extract source code or models, except where the law permits this despite this restriction;
• bypass parental gates, purchase controls or security features;
• submit false data to the research database or interfere with ArtiKO's services; or
• use ArtiKO in a way that is unlawful or harmful to a child.

10. Privacy

Our Privacy Policy explains how ArtiKO handles information. In short, camera, depth and microphone signals are processed only on the device and never recorded or transmitted, and ArtiKO contains no advertising or third-party tracking.

11. Disclaimers

To the extent permitted by law, ArtiKO is provided "as is" and "as available". We don't promise that ArtiKO will be uninterrupted or error-free, or that it will produce any particular therapeutic outcome. Nothing in these Terms excludes warranties or rights that cannot be excluded under the consumer protection law that applies to you, including Türkiye's Law No. 6502 on Consumer Protection and the mandatory laws of your country of residence.

12. Limitation of liability

To the extent permitted by law, Nihilio Vision is not liable for indirect, incidental, special or consequential damages, or for decisions made in reliance on ArtiKO instead of professional advice. Our total liability for any claim relating to ArtiKO is limited to the amount you paid for ArtiKO in the 12 months before the claim, or USD 50 if you paid nothing.

These limits don't apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud or gross negligence.

13. Apple-specific terms

• These Terms are between you and Nihilio Vision, not Apple. Nihilio Vision, not Apple, is solely responsible for ArtiKO and its content.
• Apple has no obligation to provide maintenance or support for ArtiKO.
• If ArtiKO fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for ArtiKO.
• Nihilio Vision, not Apple, is responsible for addressing any claims relating to ArtiKO, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Termination

You may stop using ArtiKO at any time by deleting it. We may suspend or end your licence if you seriously or repeatedly breach these Terms. Sections 2, 8, 11, 12, 13, 15 and 16 continue to apply after termination.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. Disputes will be resolved by the courts and enforcement offices of Kocaeli, Türkiye. Consumers may also apply to the consumer arbitration committees and consumer courts that have jurisdiction. If you are a consumer living in the EU/EEA, the UK or another country, you keep the protection of the mandatory laws of your country and may bring proceedings in your local courts.

16. General

We may update these Terms. When we do, we will change the date above and, for significant changes, tell you in the app beforehand. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us about ArtiKO. If these Terms are translated, the English version prevails to the extent permitted by law.
